    1- General

    These general terms and conditions of sale govern all relations between SASU La Droguerie Naturelle (hereinafter referred to as "the seller") and the customers of the site www.droguerie-naturelle.fr (hereinafter referred to as “the customer”) wishing to make a purchase via the website www.droguerie-naturelle.fr (hereinafter referred to as “the Site”).

    This site and the general conditions of sale which govern it are written exclusively in French and subject to French law.

    In the event of a dispute, "the customer" and "the seller" represented by its manager, Jean-François Feldmann, undertake to seek an amicable settlement. If this amicable settlement is not found, only the commercial court of Strasbourg will have jurisdiction.

    The customer declares and guarantees that he has the legal and financial capacity to contract and commit.

    The seller reserves the right to modify these General Conditions of Sale at its sole discretion. The applicable General Conditions of Sale are those in force on the day the order is validated.

    2- Intellectual property

    In accordance with the provisions of the Intellectual Property Code, all texts, illustrations, photos and comments appearing on this site are strictly reserved under copyright and intellectual property rights, and this for the entire world. As such, any reproduction, even partial, of the data appearing on the site is strictly prohibited and will be subject to prosecution.

    3- Prices and promotions

    Price :

    On the site, the prices of the items are indicated in Euros, all taxes included and excluding delivery costs.

    The amount to be paid indicated in the order confirmation is the final price, expressed inclusive of all taxes and including French VAT. This price includes the price of the products, handling and packaging costs as well as transport costs.

    This amount to be paid is to be paid in full in a single payment or, at the customer's choice, in 4 monthly installments under the conditions of our partners Paypal and ALMA, and their conditions, without discounts or rebates. For more information, refer to paragraph 6 - Payment.

    The prices indicated on the site may fluctuate; the prices retained will be those in effect when the customer places the order.

    Payments are always made before the package is sent: nothing is shipped without full and effective payment.

    Promotions:

    The promotions offered on the site may be indicated as a % discount and vary depending on the quantity of identical products ordered. The products concerned by these promotions are indicated by a "PROMO" mention. These promotions apply strictly according to the quantity of identical products per order and cannot be combined.

    Other promotions may be indicated in Euros.

    It should be noted that the EGALIM law prohibits any discount, promotion or rebate of any nature for phytosanitary products, insecticides and rodenticides.

    4- Reservation of ownership

    The goods offered for sale on the site remain the property of the seller until full payment has been received.

    5- Availability

    The seller reserves the right to cancel any order from a customer with whom there is a dispute, in particular relating to the payment of a previous order. Offers are valid while stocks last. As offers are updated regularly, the availability of the products is confirmed when the order is processed. If a product should prove to be temporarily or permanently unavailable after the customer has placed the order, the seller will offer by email , and at the customer's choice, either a substitute product, a new delivery time, or a partial or complete cancellation of the order. The customer will indicate their choice to the seller by email contact@droguerie-naturelle.fr. In this case, the seller undertakes to immediately reimburse the amount of the sums corresponding to the order cancellations.

    6- Payment

    The customer can pay for their purchases by bank card (CB, MasterCard, Visa), PayPal or transfer.

    Thanks to the secure payment system we use, all order and payment data is encrypted and transmitted directly to the banking center for processing and authorization.

    From 30 € of purchase excluding delivery costs, payment can be made in 4x without fees with the PayPal payment solution. In this case, the general conditions of use of PayPal apply.

    7- Product warranty

    For products with a manufacturer's warranty, this applies as described by the manufacturer.

    8- Delivery, delivery times and costs

    Time limit :
    Orders are processed Monday through Friday from 8am to 12pm. Any order placed after 12pm (evenings, weekends, public holidays and bank holidays) will be processed the following business day.
    Unless otherwise specified by the customer when confirming their order, delivery will be made to the address indicated when opening the customer account.
    All announced deadlines are understood to be in working days (excluding Saturdays, Sundays and public holidays) on the date of actual and complete receipt of payment for the order. The seller cannot guarantee delivery times in 100% of cases, but the usual deadlines for standard deliveries are 2 to 4 days in metropolitan France and 4 to 9 working days for the rest of the world. Since the Covid events, and as a result of the strong increase in e-commerce sales worldwide, delivery companies are overwhelmed, delivery delays of several days are possible. This is unfortunately true for all delivery companies.

    Aerosols and flammable products are not permitted for air transport.
    Excerpt from "Air regulations": All explosive or flammable products are strictly prohibited, both in the cabin and in the hold, as are fire extinguishers, chlorinated products, bleach, spray paint and tear gas.

    No packages will be shipped by air if they contain aerosols. It is recommended to replace aerosols with sprayers. For example, for aerosol insecticides, replace them with BSI STOP Insects, which is non-flammable and does not contain propellant gas. This product is a general insecticide that destroys all insects.

    For any non-standard or exceptional order, the seller will provide a delivery quote to the customer who requests it.

    9- Reception of packages

    Upon receipt of the delivery, it is the customer's responsibility to check the condition of the package(s) received and the correct conformity with the order. In the event of a problem, the customer must immediately and imperatively indicate reservations in writing on the delivery note of the delivery person or on his computer terminal, and indicate any defect, missing product or damage. The customer has the right to refuse the package. If the customer decides to accept the package, it is recommended that the customer take photos of the damaged package and of the delivery note of the delivery person so that the customer's reservations appear clearly. Within 24 hours, the customer must report the incident to the seller by sending him his findings, and if possible attaching the photos, copy of the delivery note by e-mail at the address contact@droguerie-naturelle.fr . No complaint regarding the condition of the packaging, the condition or the number of products may be accepted if it has not been noted in writing on the delivery note or the electronic terminal of the delivery person. The seller reminds that in the event of a delivery problem, if the customer has accepted the package, he must imperatively keep all the items received in the state (packaging and overpackaging included) until his file is completely resolved.

    10- Packages not delivered or not collected from relay points

    In any case, if the responsibility for the malfunction for the correct delivery lies with the carrier or the seller, the customer will either be fully reimbursed or redelivered without additional costs.

    In all cases, if the customer is responsible for the malfunction for the correct delivery (for example: package not collected from a relay point despite email or SMS alerts, incomplete or incorrect delivery address, incomplete or incorrect email address or telephone number, obvious absence of the customer at the delivery address despite email or SMS alerts - NB: this list is not exhaustive), the actual delivery costs for the outward and return journeys will be the responsibility of the customer and will be deducted from the refund of their order. We draw the customer's attention to the fact that it is the actual delivery costs for the outward and return journey that will be deducted and not the contribution to the delivery costs. The actual costs may be significantly higher than the contribution to the delivery costs. These actual delivery costs for the outward and return journeys will also be deducted from the refund of the order if it had reached free postage.

    11- Seller’s liability

    The seller is required to deliver goods that conform to the order. He is responsible for any lack of conformity as well as defects resulting from defective packaging.

    The photographs on the site are not contractual.

    The seller cannot be held liable for any damage whatsoever resulting from non-compliant or professional use, if that was not their intended purpose, of the products and items sold on the site.

    For all stages of access to the site, consultation, filling out forms, placing an order, delivery of items or any other service, the seller has only an obligation of means. Consequently, the seller cannot be held liable for any inconvenience or damage inherent in the use of the network. In particular, any disruption in the provision of the service, or any external intrusion or presence of a computer virus cannot engage the seller's liability. Similarly, any event qualified as force majeure within the meaning of the case law of the Court of Cassation and having partially or completely prevented the proper preparation or delivery of an order totally exonerates the seller from any liability.

    12- Right of withdrawal and cancellation

    Withdrawal:

    Without any penalty or justification of reason, the customer has a period of fourteen days to exercise his right of withdrawal. The customer can therefore return to the seller the products he does not wish to keep. However, and to optimally manage returns, the customer agrees to strictly apply the following instructions:

    1. Before returning the items, the customer must send a return request, describing precisely the item(s) he/she wishes to return, by e-mail to the following address within fourteen days of delivery: contact@droguerie-naturelle.fr By return email, the seller will indicate to the customer the shipping address for the return of this package.
    2. To be eligible for a refund or exchange, the items that the customer returns to the seller must be in perfect condition, unused and in their original packaging. Returned items must be returned under the customer's responsibility within fourteen days of the return notice in packaging that ensures their perfect preservation during transport. All accessories and documents such as instructions, guarantees, copy of the purchase invoice must be attached. The items that the customer returns to the seller must be marketable in their original condition without any reduction in value. For bedbug covers and heated tents, due to the risk of contamination, only unopened covers and tents may be exchanged or refunded in accordance with the General Conditions of Sale of the natural drugstore, chapter 12. Any cover or tent returned and having been unpacked will be immediately destroyed and taken to the recycling center without the possibility of refund or exchange.
    3. The responsibility and return costs are entirely the responsibility of the customer.
    4. If the seller refunds the customer for an item to which benefits or promotions were linked, these benefits and promotions will be lost and cancelled.
    5. In the event of a return due to poor workmanship or non-conformity, the return costs are the responsibility of the seller who will send the customer a "free return" label to affix to the package. Returned items must be returned under the customer's responsibility, within fourteen days following the return notice in packaging ensuring their perfect preservation during transport. All accessories and documents such as instructions, guarantees, copy of the purchase invoice must be attached.
    6. If all the conditions described above are met, the seller agrees to reimburse the amounts actually collected and corresponding to the returned items, less transport costs. These amounts will be reimbursed exclusively to the customer by the same means of payment used to pay for the order within thirty days following receipt of the return notice and actual receipt of the returned package.
    7. If the instructions described above are not followed and in particular if the returned items are not in a condition that allows them to be resold in their original condition without any reduction in value or if the deadlines are not respected, the amounts corresponding to these items and their transport costs will not be refunded. In this case, the seller will notify the customer by e-mail and invite them to collect their items within thirty working days by the means they wish and at their own expense. After this period of thirty working days, these items will be definitively lost for the customer who will no longer be able to claim to recover them or to be reimbursed for them.
    8. No cash on delivery shipments will be accepted, whatever the reason.

    13- Data Protection Act

    In accordance with the legislation on the protection of personal data, and Article 1 of our Privacy Policy, you have the possibility to exercise your rights by contacting us by e-mail at contact@droguerie-naturelle.fr 

    • The right to information: we have an obligation to inform you about how we use your personal data (as described in this privacy policy).
    • The right of access: this is your right to make a request for access to data concerning you in order to receive a copy of the personal data that we hold. However, due to the obligation of security and confidentiality in the processing of personal data incumbent on La Droguerie Naturelle, you are informed that your request will be processed subject to you providing proof of your identity, in particular by producing a scan or a photocopy of your valid identity document.
    • The right to rectification: the right to ask us to rectify personal data concerning you that is incomplete or inaccurate. Under this right, the law authorises you to request the rectification, updating, blocking or deletion of data concerning you that may be inaccurate, erroneous, incomplete or obsolete.
    • The right to erasure, also known as the “right to be forgotten”: in certain cases, you can ask us to delete the personal data we hold about you (unless there is a compelling legal reason why we need to keep it).
    • The right to restriction of processing: you have the right in certain cases to ask us to suspend the processing of personal data,
    • The right to data portability: you have the right to ask us for a copy of your personal data in a common format (e.g. a .csv file).
    • The right to object: you have the right to object to the processing of your personal data (for example, by prohibiting us from processing your data for direct marketing purposes).

    However, the exercise of this right is only possible in one of the following two situations: when the exercise of this right is based on legitimate grounds or when the exercise of this right aims to prevent the data collected from being used for commercial prospecting purposes.

    You will not have to pay a fee for access to your personal data (or for exercising any other right). However, we may charge you a reasonable fee if your request is manifestly unfounded, repetitive or excessive. In this case, we may also refuse to comply with your request.

    La Droguerie Naturelle will be entitled, where appropriate, to oppose requests that are clearly abusive due to their systematic, repetitive nature, or their number.

    We may request specific information from you to confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who is not authorised to receive it. We may also contact you to obtain further information in relation to your request, in order to provide you with a quicker response.

    We try to respond to all legitimate requests within one month. This one-month period may be exceeded in the event that your request is particularly complex or if you have made several requests. In this case, we will notify you and keep you informed.

    14. Confidentiality

    Under no circumstances will the data collected on the site www.droguerie-naturelle.fr be transferred or sold to third parties. No email address will be transmitted to third parties, including our partners, except with the written consent of the interested parties. The data collected via the contact form is intended for the exclusive use of Droguerie Naturelle for the purposes of certain services offered by the site.
